this fremont battery development. the folks at tenergy are very upset to hear that their battery may have been used for the bomb. a far cry from what the batteries are designed to be used for. tenergy says it is widely used for hobbiests mainly remote control cars and trucks and sold at hundreds of mom and pop hobby shops and sold online. the company's vice president of technology says they are horrified to find out their batteries can be used in such an act. >> horrified, appalled, shocked. batteries used for toys, rc cars and trucks and to see it used in such a way is horrifying.

>> reporter: tenergy says it has sold tens of thousands of these batteries over the past two to three years. they have offered to assist the fbi and boston police but acknowledge tracing who may have purchased these batteries would be near impossible. i'm jodi hernandez, nbc bay area news. >> thank you, jodi. let's bring you up to date. no suspect has been arrested yet. earlier today some news outlets mistakenly reported there had been an arrest. nbc news did not. an 8-year-old girl was friends with the youngest victim of monday's bombing. that must have been a tough day for that little girl. >> reporter: it really was.

this was personal. 8-year-oldava grelish lost a friend this week. 8-year-old martin richard was there with his family and he was killed. >> he was very nice and generous. >> reporter:ava tells me tag was their favorite game. this 8 year old texted her father saying she wanted to be there to see the person suspected of being her buddy. >> what kind of feelings were you having? >> mad and scared. >> reporter: explain that to me. >> when i first heard i was mad at him. i don't know who would do that. i don't know what he was thinking at the time but it is really heartbreaking. >> reporter: when you say scared, explain that. >> i was actually shaking and

crying at the same time. i was texting my friend and she was crying more than me. >> reporter: we know there is no suspect in custody but that didn't stop others from gathering at the courthouse hoping for a glimpse of the suspect. >> it is an emotional thing with everything that happened in the past 48 hours. they want to see the face of the man that did it. >> we are all to come here and say that. >> reporter:ava has this advice for children. >> i say to pray for him and for his family and all of that because he had a brother and sister. the brother was okay. >> reporter: it is not just children who are praying for those who died and those who were injured in monday's blast. you can see the memorial. this is on the street where the bomb went off. we are about three blocks away. the railing is there because on

the other side it is still a crime scene. on this side it is a beautiful scene. this is the heart and soul of boston, people lighting candles and dropping off candles and notes, anything to pay tribute to those who suffered in the boston marathon bombing. live in boston, terry mcsweeney, nbc bay area news. >> the family of a marteen ezboy is doing well. aaron hern was hit by shrapnel. his father tells nbc people immediately jumped in to help after the blast. >> he was scared and obviously in pain. people came to help us pretty quickly. i'm not sure who they were. someone brought a tourniquet with a belt. it wasn't bleeding heavily but it looked like a war wound. they got him on an ambulance

pretty quickly. >> father is a football coach. at least three martinez restaurants have organized fundraisers to help the hern family. they are donating portions of their proceeds. the family doesn't know how long they will have to stay in boston as aaron recovers. and for the latest update you can visit our website at nbcbayarea.com. pressure building tonight for a change in leadership at the top of california's public utilities commission. it is an agency that regulates $50 billion every year. the tension between state lawmakers has grown since nbc bay area's investigative unit uncovered a confidential document raising questions about the commitment to safety. tony kovaleski broke the story on monday. today he was in a capital for a special hearing. >> not pleased because 2 1/2

years after san bruney it shows the culture is still not focused on safety. now the puc says it needs time to fix the problems and today a growing list of lawmakers suggesting the way to fix the problem is to change the leadership. >> simply put this report is extremely alarming. >> a report marked confidential. its contents tell the story. >> when i learned about the report my first thought was not again. it was can they get something right? >> oh, my god. >> lawmakers wanted to know why two years after the deadly and destructive explosions in san bruno -- >> we have a plane down. >> why testimonyials describe a culture where safety is still not a priority.

>> this is gravely serious. >> the findings clearly demonstrate that the culture of safety has not been a priority in the past 2 1/2 years. >> reporter: the executive director disagrees. >> we are safer now in california because san bruno happened. we are safer because of the regulatory changes. >> reporter: he said he ordered the controversial report to candidly identify what needs to be fixed inside the puc. >> turning the public utilities safety culture after 100 years of history will not happen overnight. >> reporter: he says it will take another 2 1/2 years to get the culture to focus on safety, an answer and a prediction that did not sit well with lawmakers. >> i candidly come to the point where i believe it is time for us to have significant change in the leadership of the public

utilities commission if we are going to absolutely get the change in safety culture that is necessary in california. >> reporter: and that pressure follows a move by senator hill asking brown to fire the president of the puc. >> will you step down should mr. peavey step down? >> i report to the commissioners. it is up to them to decide. i can tell you every day that i am executive director i am going to keep pushing for safety culture change at the public utilities commission. >> leadership stresses that the report is not an evaluation of objective truth. lawmakers counter it is those views that may identify the problem. what is governor brown's position on the growing controversy? we can't tell you. his office refuses to return our calls and refusing to address

calls for change at the puc. cal trans says it questioned the work of companies who made those problematic safety bolts for the eastern span of the bay bridge. in march 1/3 of those bolts failed. hundreds of pages of documents showed inspectors found structural integrity issues several years ago. before they were installed they found these problems. the documents indicate cal trans ordered more tests on the bolts in 2008. and that the manufacturer dyson challenged the request. the documents don't reveal how or if the issue was revolved. cal trans admits the problem could delay the planned labor day opening of the new span. there are new accusations of audrie pott. this time they are targeting saratoga high school. her family says she committed suicide as a result of the sexual assault and bullying at

the hands of three male classmates. monte francis joins us with the investigation and the school's response. >> reporter: audrie pott's family just filed a new legal claim against the district which could be a precursor to a lawsuit. and the document outlines allegations against teachers and administrators at saratoga high school. >> the key for what the pott family is looking at is did the school know that audrie was being bullied? >> reporter: legal analyst says that one of the key questions in the new legal claim and the answer according to audrie pott's family is that teachers and administrators knew audrie was being bullied and failed to act. >> the dissim nation of the photographs and the bullying occurred on campus between students then that is something that the school perhaps should have prevented. >> reporter: the family also accuses the principal of

saratoga high of announcing audrie's death over the loud speaker to the student body before the family realized that she had passed away because audrie was kept on life support for organ donation for two days after she hanged herself and the family argued audrie was technically alive. the school district says the principal had permission from audrie's step mother to announce the death to the school. three 16-year-old boys have been charged with assaulting audrie while she was passed out drunk at a house party and then taking photos of the assault and sharing them. the family says the experience was so humiliating audrie took her own life. >> the first step for any college campus is to call it what it is. it is bullying and violence. >> reporter: she is a violence

prevention coordinator at san jose state and says sometimes there is a spiral of silence. >> if no one says anything no one is ever going to say anything because no one wants to be the first person to do it. >> reporter: the family's claim goes on to say that in the week before audrie's death she was confronted by a fellow student in math class and two days before her death audrie was involved in a fight at school with another student. in each case the pott family accuses teachers and administrators of failing to do anything to stop the bullying. the district issued a lengthy statement which says our internal investigation showed that audrie never reported or sought counseling for bullying before or after the alleged sexual assault. if she had our staff would have reported it and taken preventative steps to stop it. as to why the three boys were

an east bay woman is recovering after being shot in the head while sleeping in her house. police say the 24-year-old was asleep on the floor in her house. neighbors say they heard three blasts and saw shell casings on the front porch. >> based on the way the shooting occurred it does not appear that there was a random shooting into this house. it seems that the suspect was there to shoot somebody in the house. >> the woman's boyfriend says

they don't live at the house but were staying there with family. the woman is in stable condition. four people are temporarily homeless after a fire broke out in their home. the three alarm fire started just after 2:00 this afternoon at a home on ruby avenue. firefighters say a neighbor knocked on the door and helped one of the residents escape the home safely. neighbors on both sides of the burning house were evacuated for several hours. no one was hurt and the cause of the fire is under investigation. a and a bizarre fire on the peninsula. a family of nine made a frantic escape from their burning home. the father heard a car alarm and saw flames. the flames from the car were spreading to the home. he managed to get his wife and seven children out safely. businesses are always looking for the next big thing to attract customers.

all you can drink promotion. today it got attention but not the kind the race track wanted. >> reporter: when the day began the track had this new promotion to get bigger and younger crowds interested in horse racing and to get them out here to golden gate fields. we started asking questions around the community and by the time we got here the track had a change of heart. ads had been bought to promote bottomless saturdays at the golden gate fields race track. >> we had designated drivers, free water and sodas. there was food, free food for them to be eating. when it came to the actual people drinking we were never under the intention of overserving. >> reporter: mothers against drunk driving says it does not

have a problem with adults of legal age gathering and having drinks. when it comes to the subject of bottomless drinks the executive director of the madd bay area chapt chapter laid down odds. >> studies shown that promotions of this kind tend to promote benge drinking. there is concern. >> reporter: golden gate fields decided to spare negativity and cancelled its bottomless saturdays promotion before it started. >> hearing from certain members of the communityt that they were concerned, golden gate fields has no goals angering the community or producing anything that would upset the community so we decided to pull it for that. >> reporter: bay area mothers against drunk driving had this response to the cancellation of bottomless saturdays promotion. they say we commend golden gate

fields for its decision to go on the side of caution. let's bring in our meteorologist. your job would be pretty easy this week. >> hard bringing in the sunshine. >> several different ways to say it is nice. that is the seven day forecast. we have clear skies. windy but the skies really cleared out. let's take you out to san francisco. we have the clear skies. golden gate bridge looking quite golden in the sunshine. no fog, no low clouds. take you to the south now into san jose and same story there. no clouds in the picture. these winds are bringing in drier air. we are losing the marine influence on our weather. the air is actually quite dry. you probably notice that if you

step along the carpet in the house. we have humidity levels down into the teens in the north bay and east bay hill tops. if this were later on in the springs this type of wind would be a concern for fire danger. for now no red flag warnings. this is acting like a hair drier which will lead to mostly 70s tomorrow. we are talking 80s in the forecast. we saw how things were cloud free. any chance of showers seattle will see that as we go through the next few days. temperaturewise we will see the numbers climbing up to the mid to upper 70s. we fast forward into friday look at the orange on the map. these are areas getting close to 80 degrees. the warmest part of the seven day forecast coming up just in time for the weekend into early next week where we could be breaking records. we'll show you how warm the seven day forecast will shape up to be coming up. the big change involving the

there is no question about it that it is a linchpin of the bay area economy but apple has been struggling. the stock price tumbling leading people to wonder about the future of apple. >> let's bring in scott budman. is it speculation or tangible? >> lots of selling in apple stock lately. for the last several months the overall market has been rising. for today the stock falling 5.5% dipping below $400 oa share. in september apple traded above

$700 a share. even as demand stays strong for the products there is concern about if in the overall economy's future. apple stores are still full of shoppers but some apple investors have an empty feeling these days. shares of the company are now down to levels not seen since 2011. is it time to panic? >> in my 30 years the warning that apple days are over and numbered have come up four or five times and apple has always rebounded. >> apple shares have soared and sunk along with the overall market even shaping things up for bay area gold buyers and sellers. he saw his shiny investments tumble hundreds of dollars in a week. >> we are going to give you a total. >> to be honest with you when i saw it i literally had a heart

a former riverside student has been identified as the third victim of the boston marathon bombing. she was at the finish line at the race. she was a foreign exchange student from china. she was studying business and math in the extension program back in 2010. she was a graduate student at boston university when she died.

mississippi man is behind bars for sending letters with suspected ricin to president obama. detectives arrested paul curtis in a department near the tennessee state line. the letter was intercepted today. yesterday the letterer was intercepted. in both cases the nobody was hurt. six votes short. the senate failed to pass a compromise bill that would have expanded background checks. many gun control advocates were hopeful since the bill did not control the controversial ban. president obama clearly angered called today's defeat a shameful day in washington. >> most of these senators could not offer any good reason why we would want to make it harder for criminals to buy a gun.

it came down to politics. >> the president voiced his disappointment surrounded by victims of gun violence including former congress woman gabrielle giffords and the families of the newtown massacre. all of them say they will try again. new evidence that the u.s. army knew that a former soldier was a dangerous man. and yet the army allowed jeremy goulet to resign rather than prosecute him. investigators found probable cause to prosecute him for rapes in 2006. his commander allowed him to resign, quote, for the good of the service. military law gives commanding officers discretion on handling rape charges. he denied committing the first rape and charges against him in the second rape were later dropped. it is a therapy that promises to help gay people turn

straight. should it be allowed here in california? one federal court took on the controversial debate this morning. a nearly two-hour long hearing in san francisco debated the ban on gay conversion therapy for minors. that ban was supposed to go in effect on february 1. judges grilled both sides in the case that goes down to decide if the therapy is medical treatment that the state had the power to regulate. >> the evidence presented is all of the leading major medical organizations saying it has no scientific basis and has great risk to patients. >> you can't have it. that's why it is so unprecedented and a startling violation of the first amendment. >> what exactly happens in these gay conversion sessions?

three men say they went through the therapy and one says it worked. >> reporter: peter was married for 28 years with two kids. >> i had a girlfriend and was engaged to a woman right out of high school. >> reporter: while the world saw them smiling they were fighting desires that made them hate them selved wanting to be with other men. both decided to go to gay conversion therapy. things began to spiral down more. >> i was suicidal by the end of the time that i spent doing this. >> i planned a suicide for myself. >> reporter: what did they go through? they say it began with a lot of talking. the therapists ask them to change behaviors. >> try and lust after women. >> reporter: spend time on sports and other manly activities. >> i would learn things like how to change the oil on my car and

how to change my tires. >> reporter: there was electroshock therapy. >> they would attach probes to their chest and to their ankles but also to their genitalia and flash pictures of naked men and play porn. >> reporter: the deepest wounds comes from the therapy. >> it was deeply damaging to me and partly because i expected to change and i didn't. >> reporter: some disagree. he says he was cured after going through it for ten years. >> sometimes the homosexual feelings come up but like one of my clients said the other day this feels a lot better than sex with men. >> reporter: he believed in the therapy so much he became a reparative therapist himself. he saw the same pattern stemming

from childhood trauma. from him it was sexual abuse but mostly blame parents, mainly dad. >> the severe loss of the father experience in terms of affection, approval and affirmation. >> i would say anytime you do reparative therapy it is a form of mental torture. >> reporter: counters everything about reparative therapy is long. >> it is a form of shame base therapy. you are not good enough because you are gay. >> reporter: both sid argue their way is the right way to protect california children. a new chapter of what will be missing from tomorrow's 1906 earthquake remembrance. we saw temperatures today climbing into the 70s. still breezy outside. 74 santa rosa. 74 south of downtown san jose.

children who have migraines may have colic to blame. researchers looked at hundreds of children who suffered migraines and compared them to healthy children. they found the majority of migraine patients had colic. more studies are planned. up in smoke. that is what happens to a bill which would ban smokers from lighting up in condos or

a big day in our local history. tomorrow the bay area will pause to remember the 1906 earthquake and fire. the meeting point at 5:12 a.m. >> this year something is different at the ceremony as joe rosato, jr. shows us it is not about who will be there but who won't. >> reporter: in the long winding ta tale -- as the survivors gathered. >> there were no telephones. there was no internet. so they would meet. >> reporter: since that day survivors have gathered at the fountain every april 18th since to recall the fateful day.

with the last survivors now in their hundreds some would turn out providing a human link. >> reaching out and touching history. the survivors that have come in recent years don't have direct memory but know it from their parents. >> reporter: there are now just three known people there that fateful day. one is 111, two are 107. >> it adds to the ambience of the thing. without them i think it will go to rest pretty soon. >> reporter: as the city gathered today for a preanniversary parade 107-year-old bill dell monty turned up. he recalled the story of his father driving the family to the ferry building to escape the destruction. >> i was just born. my brothers told me. >> as the city rises tomorrow at

direction. our inland hill tops and valleys a north wind to transition to a slightly offshore breeze as things start to warm up. a bit of a sea breeze. as you look at the relative humidity still a marine weather influence across the bay. inland humidity levels dropping to the teens. look at livermore. 14% is the relative humidity. high pressure warms is up and compresses it down. the air tends to dry out and temperatures start to go up. we are going to see more of that here. clear skies will continue tonight. maybe a patch or two of low clouds. highs tomorrow we'll see more in the way of mid and upper 70s. close to 80 near santa rosa for the afternoon. for the weekend more 80s. if we can manage mid to upper 80s as some models suggest that will get us close to breaking records. in the meantime high pressure starting to clear things out.

you see the clear skies around the bay area taking the storm track and staying way off to the north. it is not blocking everything coming into the west coast. some reaching seattle. plan on showers but for the bay area this is like a wall blocking these incoming storms and that high turns stronger early next week our temperatures will continue to climb on up. hour by hour tomorrow morning sunglasses everywhere. you suspect the coast, inland valleys going hour by hour. nothing changing on this map because high pressure is acting like a hair drier keeping skies clear and drying things out to sea level. mostly sunny skies. morning temperatures mostly in the 40s. perhaps closer to 50 in san francisco. some of the inland wind protected valleys a chance of dropping closer to 40. we think the breezes will stay up enough. tomorrow we see the numbers probably about five degrees warmer than today.
